Get a legal team or lawyer dude on retainer. A good lawyer fighting on the outside makes a difference. If there’s future potential illegalities in pursuit of a story, keep them clued in to exactly what you’re doing, shoot them legal questions of what ifs before, memorize their number, have timed follow ups in case you go missing during a report. Dramatic conclusion, hope it doesn’t curb the fidelity you use to understand stories. Good work, stay up.

Why would an American citizen need to cross the border without going through a port of entry? Answer: because they're doing something illegal. Maybe they have a warrant, maybe they have contraband, maybe smuggling people. There are no legitimate reasons for entering the US that way, so obviously it's illegal. If you do have a legit excuse like AC, BP does their investigation, and then send them on their way. Sounds like they handled it well.

Just wanna say this. Andrew says that he might have gone "too far" with this series of videos but I wholly disagree. Andrew is giving the realest and most eye-opening look into what our current immigration situation actually looks like. I read a lot about US events and politics and there is no source that I believe gives such an unfiltered view into what is really happening at the border and what it's really like for people migrating here illegally. There is no agenda here, this is not like when liberal media and politicians virtue signal about the plight of immigrants or when the conservatives stoke fear and nativism about the current situation. Both tactics only serve to drive us further apart and set the partisans on both sides to dig in their heels even further. Three moments that I have found eye opening from these videos. 1. The fact that our govt is giving illegal immigrants thousands of dollars to help them disperse across the country and keep this issue quiet. What kind of message does this send to those hoping to follow them? Where is this kind of aid for the impoverished and homeless that are already suffering in EVERY major city 2. The trumper that gave the ole "we want them to come in legally" argument that is such an overused dog whistle that it's deafening to my ears. 3. The complete media circus that the conflict between Governor Abbot and biden has become, another argument that legacy media is failing this country and directly contributing to the division in the country. I am so sick of this endless cycle and endless struggle of American against American. We have to choice a 3rd way there is no future where all of a sudden a damn breaks and the left or right becomes ascendant. We have to vote 3rd party or independent all the way down the ballot in November. Show the democrats and republicans that we are soooo fucking sick of this status quo. This is real muckraking journalism, opening our eyes to what's happening. Logical presentation of the real crises in the country and fighting back against the party line that is preached by both sides. Wealth inequality is at gilded age levels, the highest of all time in American history. Andrew is following in the steps of the muckrakers of the time like Uptin Sinclair and Ida Tarbell. Keep it up Andrew!

I don't think Andrew and Susan could've been criminally charged with violating Title 8, Section 1185(b) of the United States Code, which is why I think they released them! True, it reads, "Except as otherwise provided by the President...it shall be unlawful for any citizen of the United States to depart from or enter, or attempt to depart from or enter, the United States unless he bears a valid United States passport." 8 U.S.C. § 1185(b). HOWEVER, Texas Federal Courts sit in the 5th Circuit of the Federal Court System. Federal Trial Courts in Texas must follow any 5th Circuit Court of Appeals judge-made law. There's a court case WORTHY v. UNITED STATES (Worthy v. U.S. (5th Cir. 1964) 328 F.2d 386). The court of appeals was reviewing Mr. Worthy's conviction (who was also a US citizen journalist) who reentered the US from Havana, Cuba in 1961 without a passport. (He was denied a passport renewal at the time because he refused to commit to not travel to Communist China and Hungary, which the US was telling its citizens it couldn't do at the time.) At the trial level, Mr. Worthy was tried "before the court without a jury and [Mr. Worthy] was found guilty as charged. He was sentenced to three months imprisonment and nine months probation." Worthy v. U.S. (5th Cir. 1964) 328 F.2d 386, 390. Mr. Worthy appealed, and the 5th Circuit Court of Appeals reversed Mr. Worthy's conviction and remanded the case back to the trial court to have the case dismissed. In its opinion, the court said, “The right to travel is a part of the ‘liberty’ of which the citizen cannot be deprived without due process of law under the Fifth Amendment.” Worthy v. U.S. (5th Cir. 1964) 328 F.2d 386, 392. It continued by saying, "We do not think that a citizen, absent from his country, can have his fundamental right to have free ingress thereto subject to a criminal penalty if he does not have a passport. The citizen, culpable though he may have been in leaving his country without a passport which he could not obtain, and subject, as he probably was, to a criminal penalty for departing without a passport, cannot, we think, be required to choose between banishment or expatriation on the one hand or crossing the border on the other hand, being faced with criminal punishment and the loss of some of the rights and privileges of citizenship as a felon." Worthy v. U.S. (5th Cir. 1964) 328 F.2d 386, 394. It concluded by saying, "the Government cannot say to its citizen, standing beyond its border, that his reentry into the land of his allegiance is a criminal offense; and this we conclude is a sound principle whether or not the citizen has a passport, and however wrongful may have been his conduct in effecting his departure. Worthy v. U.S. (5th Cir. 1964) 328 F.2d 386, 394. TLDR: I don't think Andrew and Susan could've have been charged with a crime for crossing the Rio Grande into Texas because the federal court which the federal prosecutors would've had to file the criminal charges in would've determined what they did wasn't a crime according to Worthy v. U.S. I don't know if Andrew and Susan were ultimately charged with a crime after the fact, but it seems like they weren't considering how they released them.
